A KMKSZ ungvári székháza ellen elkövetett támadás ügyének bírósági tárgyalása már idestova két éve tart. Mint korábban számos alkalommal, most is valamelyik fél távolmaradása miatt kellett elhalasztani az ülést. Most a vádlott nem jelent meg a tárgyalóteremben.
Az ügyész szerint az ügy további tárgyalása nem lehetséges Krivics nélkül, ezért azt kérte a bíróságtól, hogy halassza el a tárgyalást a következő kijelölt időpontra. A kérést a vádlott ügyvédje is támogatta.
A következő tárgyalást március 11-re tették át.

A Kárpátaljai Magyar Kulturális Szövetség (KMKSZ) ungvári székháza ellen robbantásos merényletet elkövető két vádlott ügyének tárgyalása február 17-én 9 órára (k.-e. i. sz.) volt kitűzve az Ungvári Városi-Járási Bíróságon, ami hagyományosan közel egyórás késéssel vette kezdetét. Emiatt elmaradt a két másik megyében működő bírósággal betervezett videokonferencia, melynek keretében vallomást tettek volna azok a tanúk, akik objektív okok miatt nem tudnak Ungvárra utazni.
A tárgyaláson a vádlottak védőügyvédei bizalmatlansági indítványt nyújtottak be az egyik bíróval, V. Dankóval szemben, aki véleményük szerint nem tárgyalhatja elfogulatlanul az ügyet, mert a hivatalos éves jövedelembevallásában szereplő adatok szerint felesége támogatást kapott a „KMKSZ” Jótékonysági Alapítványtól. Ezzel a vádlottak is egyetértettek. Ezenkívül a vádlottak összefüggést véltek felfedezni a tárgyalások elnapolása és az adott bíró, valamint a sértett fél képviselőjének egyidejű távolmaradása között. A háromtagú bírói testület közel egy óráig tanácskozott, végül részben helyt adott az indítványnak. Ez azt jelenti, hogy alaptalannak tartják a felvetést, hiszen az adott bíró gyereke egy ungvári óvoda magyar csoportjába jár, így részesült magyarországi óvodai gyermekétkeztetési támogatásban, amelyet az említett alapítvány folyósít.
A testület döntésképtelenné vált, s ezzel a tárgyalást meghatározatlan időre berekesztették, hogy a bíróság központi automatikus rendszere új bírót jelöljön ki, a vádlottakat pedig a konvoj visszaszállította a büntetésvégrehajtó intézetbe.
Délután 13 órára már új összetételben újabb tárgyalást hirdettek, amely kevéssel 15 óra előtt vette kezdetét, mert közben a vádlottak védőügyvédei fellebbezést nyújtottak be ügyfeleik ideiglenes előzetesben tartása miatt a Kárpátaljai Megyei Fellebbviteli Bíróságra. A frissen kijelölt bírónő ellen úgyszintén bizalmatlansági indítványt fogalmaztak meg. A védőügyvédek szerint törvénytelen, hogy az ügy tárgyalásában korábban elnöklő bíróként részt vevő személyt újrasorsolta az automatikus rendszer. K. Benca bírónő 2018 júliusában a bírói kollégium akkori elnökeként beadványt nyújtott be, melyben kérte, vonják ki a büntetőügyből. Az ok: megsértették az automatikus bírókiválasztás folyamatát, és ismételten őt jelölték ki az ügyet tárgyaló kollégium tagjává.
A védőügyvédek azt is megjegyezték, hogy mivel a károsult fél jogi képviselője nem jelent meg sem a délelőtti, sem a délutáni tárgyaláson, nem biztosak abban, hogy megfelelően értesítve voltak, és emiatt is a tárgyalás elnapolását kérték. A testület mindkét indítványt elutasította.
Mivel épp lejárt volna a vádlottak előzetesben tartásának korábban elrendelt időtartama, az ügyész ismételten kezdeményezte annak meghosszabbítását további 60 napra. Ezt ismételten a korábban is felhozott indokokkal támasztotta alá. Véleménye szerint nem szűntek meg a korábbi kockázatok, és szabadlábon történő védekezésük esetén megszökhetnek az igazságszolgáltatás elől, szociális státuszuk és kapcsolataik révén rejtőzködhetnek, illetve nyomást gyakorolhatnának a tanúkra. A vádlottak ügyvédei az Emberi Jogok Európai Bíróságának korábbi határozatait hozták fel tiltakozásukkor. Kérték védenceik szabadlábon történő védekezését. Ugyanezt kérte a két vádlott is. Az egyikük szívbeteg, és állítása szerint nem biztosítják a kivizsgálását, illetve megfelelő gyógykezelését. A másik vádlott a fogászati kezelések hiányát tette szóvá ismételten.
A bírói testület helyt adott az ügyész keresetének, így a KMKSZ-székház két robbantója újabb két hónapig, április 15-ig előzetesben marad.
Nos, a közel egész napos tárgyalás ellenére a székház ellen elkövetett robbantásos támadás két elkövetőjének ügyében nemhogy előrelépés nem történt, de előfordulhat, hogy az új bírónő bevonása miatt visszalépés lesz. Azaz a már kihallgatott tanúkat újra beidézik, és akár az írásos dokumentumok újravizsgálásáról is dönthet a háromtagú testület a február 28-ra meghirdetett következő tárgyaláson.

Viszont a bíróságon elhúzódott egy másik ügy tárgyalása, ami miatt nem sikerült a meghatározott időben elkezdeni Kosztyantin Krivics ügyének kivizsgálását. Élve a késés adta lehetőséggel, a vádlott ügyvédje kérvénnyel fordult a bírósághoz, hogy tegye át a tárgyalást egy másik időpontra.

Az Ungvári Körzeti Bíróságon videokonferencia keretében készültek kihallgatni három tanút a KMKSZ ungvári székháza elleni merényletet elkövető két vádlott ügyében. A tanúk Kirovográd két kerületi bíróság terméből léptek volna kapcsolatba, de a tárgyalásra nem került sor, mert a bírói testület nem tudott teljes létszámban megjelenni.
Az ügy tárgyalása jelenleg nagyon lassan halad. A meghallgatásokat kitűzik, de a fele sem történik meg. A következő ülésen, február 17-én ismét megkísérelnek egy távolsági kihallgatást folytatni videokonferencia keretében Kirovohradból. Ellenkező esetben a bizonyítékok vizsgálati sorrendjének megváltoztatását kérik majd a bíróságtól.

Folytatódik a tárgyalás a Kárpátaljai Magyar Kulturális Szövetség (KMKSZ) ungvári székháza ellen elkövetett robbantásos merénylet szervezőjének, Kosztyantin Krivics ügyében. Az Ungvári Városi-Járási Bíróság legutóbbi ülésén január 14-re és január 17-re tűzte ki a vádlott ügyének tárgyalását.
Kedden a meghirdetett időpontban valamennyi résztvevő megjelent a
tanácskozóteremben. Denisz Hirják ügyész ismertette a testülettel az
előzetes tárgyaláson való hiányzásának okát, amikor úgy döntöttek, hogy
videokonferencián fogják kihallgatni az egyik tanút, egy rendőrt. Ez
technikai okok miatt nem történt meg. Mivel a tanúk, közte a biztonsági
szolgálat munkatársai is, folyamatosan nem jelennek meg a tárgyalásokon,
az ügyészség panasszal fordult a biztonsági szolgálat kárpátaljai
kirendeltségének vezetőjéhez. Ezután a hatékony időkihasználás érdekében
az ügyész kérte a bizonyítékok vizsgálati sorrendjének
megváltoztatását. A vádlott ügyvédje kérte az írásos bizonyítékok
vizsgálatának elhalasztását, de nem ellenezte a sorrend
megváltoztatását. A felek hozzáláttak a 118 okirat vizsgálatához. Az
első húsz okmánnyal kapcsolatban a védőügyvédnek nem volt megjegyzése, a
helyszíni szemle jegyzőkönyvét vizsgálva azonban Valerij Borogyij
ügyvéd kérte a vizsgálat elnapolását, mivel mint mondotta: ebből nem
volt kellően felkészülve, nem voltak nála az ezzel kapcsolatos
jegyzetei, mert a tanúk kihallgatására készült. A bírói testület
elfogadta az ügyvéd kérését, és időt adott számára, hogy
megismerkedhessen az ügy anyagaival. A tárgyalást berekesztették.
Pénteken megjelent egy tanú, így nem az írásos bizonyítékok
vizsgálatával folytatták, hanem áttértek a megjelent tanú
meghallgatására, aki egy ügyész. A férfi a KMKSZ-székház ellen
elkövetett merénylet két kivitelezőjének ügyében is részt vett. Jelen
volt a vádlott Kropivnickijben történt kihallgatásánál.
Ezután videokonferencia keretében került sor egy másik tanú, egy
SZBU-munkatárs meghallgatására, aki szolgálati kötelezettsége
teljesítése miatt nem tud személyesen megjelenni. A biztonsági szolgálat
dolgozója részletesen kitért a robbantásos merényletet megelőző
történésekre, a kivitelezők és a szervező közötti kapcsolat
kialakulására a kárpátaljai helyzet instabilizálása céljából, folyamatos
együttműködésére, beleértve az érintettek útvonalát, a jármű márkáját,
amellyel Kárpátaljára utaztak, a feltérképezett és további merényletek
tárgyát képező objektumok listáját (vasúti viaduktok a Kárpátokban
stb.), a robbantás éjszakáján történtekre és az elkövetők őrizetbe
vételét követő eljárásra.
Mivel január 24-ig lejárt volna a vádlott fogva tartásának
időtartama, Denisz Hirjak ügyész kérelmezte, hogy újabb 60 nappal
hosszabbítsák meg azt. Elhangzott, hogy Kosztyantin Krivicset különösen
súlyos bűntény elkövetésével vádolják, aki hónapokig megpróbált
elrejtőzni a felelősségre vonás elől, ennek érdekében hamis ukrán
útlevelet is készíttetett. Az ügyész szerint szabadlábon történő
védekezés esetén elmenekülhet az igazságszolgáltatás elől, nyomást
gyakorolhat a tanúkra, és a még mindig menekülésben lévő másik
szervezőre. A vádlott ügyvédje ezzel szemben enyhébb óvintézkedés
alkalmazását kérte Kriviccsel szemben. Valerij Borogyij véleménye
szerint védence nem jelent veszélyt az ügy többi résztvevőjére, ezért
arról próbálta meggyőzni a bíróságot, hogy a továbbiakban Krivics házi
őrizetben védekezhessen. Érvként azt is felhozta, hogy védence a
lakhelyén pozitív jellemrajzot kapott, 2014-ben önkéntesként részt vett
az ATO-ban, valamint a 2011-es születésű gyermeke és 2. kategóriájú
rokkant édesanyja is a gondoskodására szorulna.
A háromtagú bírói testület rövid tanácskozás után az ügyész kérésének
tett eleget, és újabb 60 napra meghosszabbította a KMKSZ-székház
felrobbantásának szervezésével vádolt férfi fogva tartását, aki így
március 13-ig előzetesben marad.

a férfiak négy szírt és nyolc irakit vittek a magyar–osztrák
határ felé ukrán rendszámú kisbuszukkal, amikor a rendőrök az
M1-es autópályán, Tatabánya közelében ellenőrizték a
járművet.
A férfiak tudták, hogy az általuk szállított
személyek az Európai Unió területére vonatkozó beutazási és
tartózkodási engedély nélkül érkeztek Magyarországra és
jogellenesen szeretnék átlépni a magyar–osztrák
határt – közölte a hatóság.
Az ítéletet az ügyész tudomásul vette, a
vádlottak azonban fellebbezést jelentettek be. A bíróság az
ügyész indítványára elrendelte a vádlottak letartóztatását.

15 év börtönbüntetésre ítélte a szlovákiai Bazin különleges bírósága hétfőn Andruskó Zoltánt, aki közvetítő szerepet játszott a Ján Kuciak tényfeltáró újságíró és barátnője ellen tavaly februárban elkövetett gyilkosság megrendelője és elkövetője között – közölték szlovák médiaforrások.
Az ítélet jogerős, tekintve, hogy Andruskó Zoltán – aki a
vádirat szerint a bérgyilkosság kifizetését intézte – egy korábban megkötött
vádalku keretében elismerte tettét és elfogadta a büntetést. A büntetés
eredetileg – az ügyész javaslata alapján – tíz év szabadságvesztés lett volna,
ám ezt a bíróság elégtelennek találta, és hétfőn 15 évre változtatta. Andruskó
elfogadta a változtatást.
A súlyos belpoltikai viharokat kiváltó gyilkosság ügyében
még októberben nyújtották be a hat vádpontot tartalmazó, közel százoldalas
vádiratot, ám a tárgyalássorozat csak az év végén kezdődött meg. A pernek
Andruskó az első jogerősen elítélt szereplője.
A per további vádlottjai közé tartozik Marián K.
nagyvállalkozó, aki a vádirat szerint azért rendelte meg Ján Kuciak
meggyilkolását, mert az újságíró több cikket is publikált az ő állítólagos
gazdasági bűncselekményeiről. A kettős gyilkosság végrehajtásával a tettüket
már beismerő M. Miroslavot és Sz. Tamást vádolják. A vádlottak között van Zs.
Alena is, aki a vádirat szerint szintén összekötő szerepet játszott a
gyilkosság megrendelése során.
A két áldozattal a galántai járásban, Nagymácsédon lévő
családi házukban végeztek a gyilkosok. A bűncselekmény közfelháborodást váltott
ki Szlovákiában, s heteken belül példátlan tüntetéssorozathoz, illetve mély
belpolitikai válsághoz vezetett. A történések végül a kormány több tagjának
távozásához, Robert Fico kormányfő lemondásához és kabinetjének széleskörű
átalakításához vezettek.

Sor került az idei év utolsó bírósági tárgyalására a KMKSZ ungvári székháza elleni merénylet ügyében. A mostani tárgyalás során technikai probléma miatt nem sikerült videó kapcsolatot létesíteni a Kirovográd megyei bíróságokkal, ezért nem sikerült az ottani tanúk meghallgatása. A tárgyaláson nem jelentek meg a helyi tanúk sem. Bár a tanúknak megküldték az idézést, de többségük nem lakik az általuk megadott címeken. Esetükben további eljárás lesz foganatosítva.
Az ügyész azt javasolta, hogy a bíróság térjen rá az írásos bizonyítékok kivizsgálására, de a gyanúsítottak ügyvédei bizalmatlansági indítványt nyújtottak be a bírói testület ellen. Szerintük a testület elfogult, mivel nem veszi figyelembe a védelem által benyújtott kérelmeket és a fogva tartás folyamatos meghosszabbításával megsérti a gyanúsítottak jogait.
A gyanúsítottak is elégedetlenek az ügy vizsgálatának menetével. Panaszukban arra hívták fel a figyelmet, hogy elégtelen körülmények között tartják fogva őket, nem kapnak megfelelő egészségügyi ellátást, amivel kapcsolatban sem a bíróság, sem pedig az ügyészség sem tesz semmit.
A következő vizsgálati pont az ügyésznek a gyanúsítottak fogva tartásának meghosszabbítására vonatkozó indítványa volt. Az ügyész szerint a gyanúsítottakat súlyos bűncselekmény elkövetésével vádolják. Emellett a negyedik gyanúsítottat még most is körözik, a tanúk egy részét még nem hallgatták ki, és a szakemberek értékelését sem vizsgálták meg. Ennek értelmében az ügyész úgy véli, hogy a gyanúsítottakat továbbra is őrizet alatt kell tartani.
Egy másik döntésben arról is szó volt, hogy a január 24-én esedékes következő tárgyalásra biztosítsák a távolban élő tanúk videokonferencia általi meghallgatását. Azokat a tanúkat pedig, akik nem jelennek meg a következő tárgyaláson, megbírságolják.
