Olaszországban az ’ndrangheta nevű bűnszervezet több száz tagja ellen zajlik eljárás, jelenleg 91-en ülnek a vádlottak padján. Ez az utóbbi tíz év legnagyobb maffiapere.
Súlyos cselekményekért kell felelniük: gyilkossági kísérlettől a zsarolásig, durva testi sértéstől a korrupciós cselekményekig számos esetet már bizonyítottnak talált a bíróság.
Nicola Gratteri catanzarói ügyész kiemeli, hogy a 91 vádlottból hetvenet már bűnösnek ítélt a bíróság, és csak 19-et mentett fel. Azon kell dolgozni, hogy a bűntettek bizonyítást nyerjenek a bíróságon is, mert akkor nem jelent problémát a bűnösség kimondása.
A következő két évben további több mint 350 gyanúsított ügye léphet bírósági szakaszba: gengsztereké és korrupt tisztségviselőké egyaránt. A maffia felszámolás évtizedek óta azért lehetetlen Olaszországban, mert beépített embereik ott vannak minden oldalon a legmagasabb körökben a politikában, a bűnüldözésben és az igazságszolgáltatásban is.

A spanyol és az olasz rendőrség az Europol támogatásával felszámolt egy több mint 100 tagú, a maffiához kötődő kiberbűnözői csoportot, amelynek tagjait az interneten elkövetett csalással, pénzmosással, kábítószer-kereskedelemmel és más vagyon elleni bűncselekményekkel vádolnak – közölte az uniós tagállamok közötti bűnüldözői együttműködést irányító hatóság hétfőn.
A gyanúsítottak több száz áldozattól pénzt csaltak ki adathalászat, telefonkártyacserés trükkök és hamis üzleti e-mailek révén, majd a nyereséget illegális fedőcégek széles hálózatán keresztül tisztára mosták. Csak tavaly mintegy 10 millió euró haszonra tettek szert.
A házkutatások során számos elektronikus eszközt, több mint 200 hitelkártyát, telefonkártyákat, értékesítési terminálokat és marihuánatermesztéshez szükséges felszereléseket foglaltak le.
Az Europol szerint a tenerifei székhelyű bűnszövetkezet jól szervezett, különböző területekre szakosodott, piramisszerű szerkezetben működött. A banda tagjai között voltak számítógépes, illetve kriptovaluta-szakértők is.
A tagok többsége olasz állampolgár, közülük néhányan maffiaszervezetekkel állnak kapcsolatban.
Az Europol a nyomozási művelet során két elemzőt és egy igazságügyi szakértőt küldött a spanyolországi Tenerifére, egy elemzőt pedig Olaszországba. Ezenkívül az Europol finanszírozta három olasz nyomozó kiküldését Spanyolországba, hogy támogassák a spanyol hatóságokat az akció során. A hágai székhelyű szervezet számítástechnikai bűnözési munkacsoportja is támogatta a műveletet.

Megnyerte a pert egy olasz maffiózó, aki azért fordult a bírósághoz, hogy cellája magányában joga legyen a zenehallgatáshoz – számolt be róla a The Guardian pénteken.
A 48 éves Domenico Strisciugliót több mint húszévi börtönbüntetésre ítélték gyilkosságért és bűnszervezetben elkövetett bűncselekményekért. Az olasz törvények szerint a börtönhatóságoknak joga van olyan különleges szabályozáshoz, amely megakadályozza, hogy az elítéltek kapcsolatba kerülhessenek bűnözőtársaikkal. A szigorú szabályok alapján tagadták meg Strisciugliótól, hogy vásárolhasson egy CD-lejátszót. Ügyvédje azonban bírósághoz fordult, hogy védence a tévézésen kívül más szórakozást – zenehallgatást – is választhasson a cellájában.
A szardíniai Sassari bírósága csütörtökön hozta meg az ítéletet, amely engedélyezi az 1999 óta börtönben ülő maffiózónak, hogy alkotmányos jogaival élve zenét hallgathasson. A bíróság a CD-lejátszó engedélyezését azzal indokolta, hogy az elítéltnek joga van alapvető kulturális tevékenység gyakorlásához, és annak formáját nem lehet megszabni. Az indoklásban az is szerepel, hogy a televízióban látható programok nem tudják kielégíteni egy zene iránt érdeklődő ember igényeit. Strisciuglio 2019-ben már nyert egy pert, amikor azért küzdött, hogy éjfél után is tévézhessen.
Olaszországban az 1980-as és 1990-es évek maffiagyilkosságai és terrorista cselekményi után szigorították a börtönszabályokat. A börtönszabályok között szereplő hírhedt 41-es paragrafus alapján tilos a telefonhasználat, bármiféle kapcsolattartás más rabokkal, illetve találkozás harmadik féllel.
A strasbourgi Emberi Jogok Európai Bírósága (EJEB) 2019-ben megállapította, hogy a szigorú olasz börtönszabályok miatt a maffiózók embertelen és megalázó bánásmódnak vannak kitéve. Az EJEB sürgette Olaszországot, hogy vizsgálja felül életfogytiglani büntetéssel kapcsolatos törvényeit.
A strasbourgi döntés felháborodást váltott ki a nyomozók körében, akik szerint a bíróság nem vette figyelembe, hogy Olaszországban milyen beágyazottsága és története van a maffiának. Olasz miniszterek szerint a strasbourgi ítélet az egész kontinensen akadályozhatja a szervezett bűnözés elleni harcot.

Olaszország déli részén egy hónapok óta szökésben lévő, veszélyes maffiózót vett őrizetbe az olasz rendőrség egyik különleges alakulata – jelentették pénteken az olasz hatóságok.
A férfi a száz legveszélyesebb bűnöző körözési listáján szerepelt.
A dél-olasz ‘ndrangheta bűnszervezet tagját egy félreeső falusi házban találták meg Calabria tartományban Catanzaro és Lamezia Terme városok között. A férfi 2019 decembere óta volt szökésben. A kommandósok előző este ütöttek rajta alvás közben.
A nyomozást Nicola Gratteri ügyész vezette, aki a ‘ndrangheta több mint háromszáz tagjának tömegperét indította el. A perben a világ legerősebbnek tartott maffiája által elkövetett bűncselekményeket, valamint a szervezet politikai és üzleti kapcsolatrendszerét akarják feltárni.

Több mint 900 tanút hallgattak ki, köztük 58 olyat, aki korábban a szervezet tagja volt, de együttműködött a hatóságokkal.

Egyre több ukrán állampolgár nem látja a jövőjét itthon, és Nyugat-Európa országaiban keres munkát, többek között Németországban, Csehországban és a skandináv országokban. Alapvetően lengyel munkavállalási vízumot tartalmazó dokumentumokat mutatnak be határlépéskor. A német és a lengyel határszolgálat adatai szerint ezen az üzleten a bűnözői csoportok, nevezetesen a lengyel maffia gazdagodik meg – közölte a Gazeta Wyborcza, a legnépszerűbb lengyel kiadvány.
A ukrán illegális bevándorlókat elsősorban a németországi keresetek szintje vonzza, amelyek 2-2,5-szer magasabbak, mint Lengyelországban, és legalább ötször magasabbak, mint otthon. És ezt a tendenciát a koronavírus-járvány ellenére is nehéz megállítani, amely majdnem egy év óta tart.
„A vágy, hogy többet keressenek, olyannyira nagy, hogy vállalják a kockázatot” – magyarázta az egy határőr a lengyel kiadványnak.
A lengyel sajtó arra emlékeztet, hogy bár a német hatóságok megnyitották kapuikat az európai útlevél nélküli állampolgárok foglalkoztatása előtt, ennek ellenére ritkán adnak ki vízumot, és megkövetelik a német nyelvtudás igazolását.
És pont ezek az akadályok kényszerítették az ukránokat arra, hogy lengyel vízumot tartalmazó hamis lengyel dokumentumokat válasszák. Sőt, az őket toborzó bűnözők azt állítják, hogy Németországban lengyel vállalatnál fognak dolgozni.
A kiadvány azt is elmagyarázza, hogy sok ukrán Lengyelországot tranzit-országként kezeli, be akar lépni annak területére, hogy tovább mehessen Nyugat-Európába. A lengyel határőrök megjegyezték, hogy az ukránok elsősorban Németországot választják. Például szeptemberben naumburgi ügyészség utasítására 800 rendőr öt tartományban mintegy 60 lakást és vállalatot ellenőrzött. Külföldieket kerestek, akik illegálisan dolgoznak, főleg húsfeldolgozó üzemekben.
Az információknak megfelelően, egy német–lengyel bűnözői csoport hat hónap alatt, munkaközvetítői ügynökségek segítségével, 82 személyt dobott át Németországba. Sőt, az ellenőrzések során kiderült, hogy még 44 személy dolgozott hamis uniós iratok alapján. A becslések szerint a banditák mintegy 1,5 millió eurót kerestek, hangsúlyozták a lengyel újságírók. A német rendőrség összesen mintegy 1400 illegális tartózkodás és foglalkoztatás ügyét vizsgálja az ország területén.
Különleges felügyelet alatt állnak az ukrán nők, akik többségét a lengyel vállalatok ukrajnai képviselői alkalmaztak. Tomasz Bogdewicz, a Gremi Personal nemzetközi munkaközvetítői ügynökség igazgatója elmondta, hogy Ukrajnában virágzását éli a közvetítői biznisz, akik felajánlják az ukrán munkásoknak, hogy elszállítják őket Németországba, Csehországba vagy Ausztriába egy harmadik országon keresztül. Egyben hozzátette, hogy az ukránok nemcsak hamis munkaszerződéseket és vízumokat, hanem hamis Európai Uniós útleveleket is használnak.
A keleti irányból Európába tartó illegális gazdasági migráció ebben az évben több mint 100%-kal nőtt. A lengyelországi munkavállalási engedély megszerzésének egyszerűsített eljárása pedig hozzájárul ennek a tendenciának a növekedéséhez. „Lengyelország az EU külső határa, és ezért mindent meg kell tennie határa lezárása érdekében” – emelte ki a Gazeta Wyborcza kiadvány.

Az Odüsszeusz-műveletnek keresztelt, rendkívül sikeres olaszországi nyomozást Grazia Pradella speciális ügyész vezette, akinek egysége összesen 22 ember után nyomozott. Az egész csapatból csupán egy emberről véli úgy az ügyészség, hogy nem vett részt a bűncselekményekben.
Az eddigi adatok szerint a korrupt csendőrök a környéken rátelepedtek a drogkereskedelemre, még a kis dílereket is ők irányították. Nemritkán olyan anyagot árultak, amelyet korábban ők maguk koboztak el. A mostani letartóztatási hullám hosszúra nyúlt eljárás eredménye, hiszen jó ideje lehallgatták az érintetteket. A banda a koronavírus miatti korlátozások idején követte el a legsúlyosabb bűncselekményeket: a csendőrök nemegyszer vertek félholtra külföldieket, elsősorban színes bőrűeket. Egy egyiptomi férfit, akit azzal gyanúsítottak, hogy drogot árul, úgy összevertek, hogy később az egyik csendőr bevallotta, amikor meglátta a padlón a rengeteg vért, azt gondolta, a férfi már nem él.
A bűnszervezet fejének a nápolyi származású, 37 éves Giuseppe Montellát tartják, akit környezete veszélyes és agresszív embernek ismer. A lehallgatott felvételekből kiderül, volt, hogy rendőri biztosítást adott a drogot szállító járműveknek az utakon, továbbá a tervei között szerepelt, hogy komolyabban beszáll a kokainbizniszbe. A csendőrbűnözők módszereit a Camorráéhoz hasonlítják. Az eljárás alá vont csendőröket drogkereskedelemmel, lopott áruk értékesítésével, hivatali visszaéléssel, zsarolással, kényszerítéssel és kínzással is összefüggésbe hozták.

Ítéletet hirdetett a Besztercebányai Járásbíróság Mikuláš Černák egykori szlovák maffiafőnök és régi barátja, Miloš Kaštan ügyében, akik több mint egy tucat embert gyilkoltak meg – írja a Parameter.sk.
Mikuláš Černák mivel más ügyben életfogytig tartó börtönbüntetését tölti, további büntetést nem kapott. Őt 16 vádpontban találták bűnösnek. Miloš Kaštan 14 éves börtönbüntetését tölti, 20 év és egy hónap összbüntetést kapott. 16 emberölést és két kísérletet sikerült a büntetőeljárás során felderíteni. A gengszterek az összeset beismerték.
A ’90-es évek ismert maffiózói a portál szerint az elmúlt években kezdtek együttműködni a hatóságokkal. Mikuláš Černák kezdte a beismeréseket, majd barátja is csatlakozott.
Ennek eredményeként összesen 14 gyilkosságot, valamint 2 gyilkossági kísérletet sikerült felderíteni, és mivel mindkét gyanúsított teljes mértékben beismerte ezek elkövetését, vádalku következett – fogalmaz a Parameter.sk cikke.
A besztercebányai és az országos alvilágot egykor irányító páros ügye augusztus 11-én került a Besztercebányai Járásbíróság elé. A tárgyaláson az ügyész ismertette a vádakat, melyekben többek között a dunaszerdahelyi Hodossy Rudolf, „Kis Cine” lefejezése és bodrogközi maffiózók, Tóth Gyula és Muszka Péter likvidálása is szerepel. A vádlottak a büntetés-végrehajtási intézetből jelentkeztek be. Személyesen nem voltak jelen a tárgyalóteremben. A vádpontokat beismerték sajnálkoztak az általuk elkövetett kegyetlen gyilkosságok miatt, amelyeket anyagi haszonszerzés vagy riválisaik eltávolítása céljából követtek el. De előfordult az is, hogy bosszúból vagy szívességből gyilkoltak.
Miután bocsánatot kértek az áldozatok családjaitól, a bíró jóváhagyta a vádalkut. Mikuláš Černák élete végéig börtönben marad. Miloš Kaštant az őt érintő 6 vádpontban találta bűnösnek a bíróság – ő 20 év és egy hónap összbüntetést kapott, amely felülírja azt a 14 éves szabadságvesztését. Mivel a döntés vádalku keretén belül született, azonnal jogerőssé vált, és nem lehet ellene fellebbezni.
Szlovákiában az életfogytiglanra ítélt személyek 25 év letöltése után kérelmezhetik feltételes szabadlábra helyezésüket. Mikuláš Černák négy év múlva nyújthatja be az első ilyen kérelmét – jegyzi meg a Parameter.sk.
