A kárpátaljai fellebbviteli bíróság nem értett egyet a rahói járási bíróság 2022. április 13-i határozatával, amely megtagadta a felperestől az anya szülői jogainak megvonását két kiskorú gyermekét illetően.
Az ügy körülményei
A férj 2021 júniusában pert indított volt felesége ellen – közös gyermekeik édesanyja szülői jogaitól való megfosztását illetően. Az indítványt azzal indokolta, hogy 2012 júliusától 2016 szeptemberéig a felek házasok voltak, ez idő alatt két fiuk született.
A válás során a feleknek nem volt vitájuk a gyermekek elhelyezését illetően – az édesapjukkal maradtak, jelenleg Vinnyica megyében élnek, és az apa tartja el őket. Az édesanya a válás óta nem vesz részt fiai életében, anyagi támogatásában és nevelésében, életük soha nem érdekelte, sőt, a gyerekek számára is idegen maradt.
Az elsőfokú bíróság határozata
A rahói járási bíróság 2022. április 13-i határozatában a keresetet elutasította. A bíróság álláspontját azzal indokolta, hogy a felperes nem bizonyította, hogy az anya szándékosan bújt ki a gyermeknevelési és eltartási kötelezettségei alól.
A fellebbviteli bíróság határozata
A kárpátaljai bíróság hatályon kívül helyezte az elsőfokú bíróság elutasító határozatát, és a vádlottat megfosztotta szülői jogaitól.
A bíróság az ítéletet azzal indokolja, hogy az ügy anyagai értelmében a gyerekek az apjukkal élnek, és ő tartja el őket. A felperessel való válás után az alperes nem él együtt a gyerekeivel: nem törődik testi-lelki fejlődésükkel, nem kommunikál velük, még telefonon sem, nem vesz részt eltartásukban.
A nő soha nem fizette a bíróság által 2016-ban meghatározott tartásdíjat, ami miatt a hátralék összege 2022. május 1-jén csaknem 135 ezer hrivnyát tett ki.
A bíróság megállapította, a vádlott egy rahói járási településen és ott is van bejelentve. A tényleges lakóhelye és tartózkodási helye viszont jelenleg nem ismert.
A település elöljárója által megadott jellemrajz szerint a gyerekek édesanyja hajlamos az alkoholfogyasztásra. Ezért a jelen ügy körülményei között a felperes bizonyította a volt feleséggel szembeni azon szélsőséges intézkedés alkalmazásának szükségességét, mint a gyermekek feletti szülői jogától való megfosztás.
Tájékoztató. Az előzetes adatok szerint tavaly 12 helyi bírósági határozatot vizsgált felül a Kárpátaljai Ítélőtábla a szülői jogok megvonásával kapcsolatos ügyekben. Az esetek elemzése azt mutatja, hogy általában az egyik szülő fordult a bírósághoz szülői jogok megvonására vonatkozó keresettel (6 esetben a volt feleség, 2 esetben a volt férj), 2 esetben – a gyámhatóság. Emellett egy esetben a gyermek nagyapja volt a kezdeményezője az anya szülői jogainak megfosztása kapcsán, egy másik esetben a kiskorú fiú kérte apja szülői jogainak megvonását, számolt be a kárpátaljai fellebbviteli bíróság sajtószolgálata.

Bejelentés érkezett a hatóságokhoz május 12-én, miszerint Rahón, egy üdülőkomplexum közelében vita alakult ki két férfi között. A helyszínre azonnal kiérkezett az operatív csoport.
A 26 éves ittas férfi összetűzésbe került 30 éves ismerősével, többször is ütést mért fejére és testére egy fémbottal, majd mellkason szúrta egy késsel. Mint kiderült, a konfliktus féltékenység miatt alakult ki.
Az áldozatot elsősegélyben részesítették, nincs életveszélyes állapotban. Az elkövető ellen büntetőeljárás indult, öttől nyolc évig terjedő szabadságvesztés várhat rá.
A hírt a rendőrség kommunikációs osztálya közölte.

A rahói rendőrség bíróságot megelőző büntetőeljárást indított annak az iskolásnak az ügyében, akit bántalmazott az egyik tanárnő az óra alatt.
A hatóságok felfigyeltek egy, a közösségi oldalakon terjedő videofelvételre, melyen jól látható, hogy egy tanárnő veszekedik és többször is fejen üt egy gyereket a tanórán.
Az ügyben folynak a vizsgálatok, a rendőrség több szemtanút, s a szülőket is kihallgatta, akik nem tettek feljelentést a pedagógus ellen.
