Újra kell kezdeni a Dmitro Firtas ukrán oligracha amerikai kiadatási kérvénye ügyében folyó bírósági eljárást – döntött pénteken az illetékes osztrák bíróság.
Firtast azzal vádolják, hogy megvesztegetéssel szerzett engedélyt Indiában titánérc kitermelésére, amelyet vállalkozása az Egyesült Államokba akart szállítani.
Az ukrán oligarcha tagad minden ellene felhozott vádat. A férfit 2014-ben Ausztriában vették őrizetbe az Egyesült Államok kérése, majd 125 millió euró óvadék ellenében szabadlábra helyezték. Egy bécsi bíróság előbb a kiadatás ellen döntött azzal az indokkal, hogy az egyesült államokbeli vádemelés politikai indíttatású volt. A fellebbviteli bíróság azonban 2017 februárjában megalapozatlannak minősítette és elutasította ezt az érvelést, és úgy ítélte meg, hogy Firtas kiadható. Az osztrák legfelsőbb bíróság 2019-ben helybenhagyta ezt az ítéletet. Az ország igazságügyi minisztere akkor jóváhagyta a kiadatást, de az illetékes bécsi bíróság a védelem keresetét helyben hagyva, úgy döntött, hogy az elejétől újra kell tárgyalni az ügyet.
2022 márciusában a bécsi bíróság elutasította az ügy újbóli megnyitását.
A tartományi bíróság azonban most közölte, hogy Firtas javára döntött, és úgy határozott, lehetővé teszi a kiadatási eljárás újraindítását, hatályon kívül helyezve a 2017-es ítéletet.
Indoklása szerint újabb bizonyítékok kerültek elő. A bécsi bíráknak most újra meg kell fontolniuk, hogy Firtast Ausztria kiadhatja-e az Egyesült Államoknak.
2019 júniusában egy chicagói szövetségi bíró elutasította az ukrán oligarchának a vádemelés elutasítására irányuló indítványát, amelyben Firtas azzal érvelt, hogy az Egyesült Államok nem rendelkezik joghatósággal az Indiában elkövetett bűncselekmények felett. A bíró ezzel szemben úgy ítélte meg, hogy igenis rendelkezik, mert az hatással lett volna egy chicagói székhelyű cég, a Boeing amerikai légiközlekedési vállalat tevékenységére. A cég ugyanakkor azt állította, hogy fontolóra vette ugyan az üzlet megkötését Firtassal, de ezt végül nem tette meg.
Közben 2021 augusztusában Ukrajnában bírósági határozattal az ukrán állam tulajdonába került a szankciókkal sújtott Firtas Titán-Magnézium Kombinát elnevezésű zaporizzsjai vállalata.
