A wisconsini törvények szerint bizonyos súlyos bűncselekmények esetében már egy 10 éves korú gyermekeket is felnőttként lehet kezelni – a fiú ügyvédei kérhetik, hogy a védencüket fiatalkorúként kezeljék – de jelenleg jogi értelemben felnőttként kell a vád elé állnia az anyagyilkos fiúnak – írja a Fox News.

A gyilkosság nem sokkal reggel 7 óra előtt történt még november 21-én. A fiú először azt mondta a rendőröknek, hogy a fegyvert az édesanyja hálószobájából vette el, és az alagsorba ment, ahol a nő éppen mosott – ekkor sült el véletlenül a fegyver.
A rendőrök hittek neki, ezért a történtek ellenére a családjával maradhatott.
A fiú később viszont a családnak bevallotta, hogy szándékosan fogta rá anyjára a fegyvert és nála volt a fegyverdoboz kulcsa is. Az anyja halála után be is lépett annak az Amazon-fiókjába és vásárolt magának egy VR headset-et.
A rendőrségnek ezután elmondta azt is, hogy aznap az anyja a szokásosnál korábban ébresztette és nem engedte neki, hogy megvegye a kinézett headset-et magának.
A fiú már korábban is furcsán viselkedett – a rokonoknak egyszer például azt mondta, hogy képzeletbeli emberek beszélnek hozzá.

Lisa Montgomeryn azt követően hajtották végre az ítéletet, hogy az ország legfelsőbb bírósága hatályon kívül helyezte Indiana állam bíróságának a kivégzés elhalasztásáról szóló döntését, amelyet a testület kedden hozott.
A kivégzést méreginjekcióval hajtották vére.
Az 52 éves Montgomeryt 2007-ben ítélték halálra Missouriban azt követően, hogy a bíróság bűnösnek találta abban, hogy három évvel korábban elrabolt és megfojtott egy nyolc hónapos terhes asszonyt, és kivágta a hasából az élő magzatot.
A bíróság Montgomery mentális állapotára hivatkozva döntött a kivégzés elhalasztása mellett: a nőre méreginjekció várt volna, a bejelentés szerint viszont nem tudta felfogni az ítélet indoklását, James Patrick Hanlon bíró pedig elrendelte a pszichiátriai vizsgálatát.
A Reuters hírügynökség emlékeztet arra, hogy nőt 1953 óta nem végeztek ki szövetségi halálos ítélet alapján.
Jóllehet Kelley Henry, Montgomery ügyvédje azt mondta, védence egyre romló mentális állapota nem teszi lehetővé, hogy felfogja az ítélet indoklását, az ügyész szerint Montgomery csupán színleli a mentális zavart, rámutatva arra, hogy a tettét előre megfontoltan, alapos tervezés után követte el.
Montgomery egy másik védője, Meaghan VerGow a Donald Trump leköszönő amerikai elnöknek benyújtott kegyelmi kérvényében kihangsúlyozta, hogy védencét egész életében bántalmazták és sorozatban megerőszakolták.
