„Найсильнішим аргументом для актора є те, що держава не зовсім точно подала інструкції великому журі, яке має виносити вирок. Це типи потенційних помилок, які можуть спричинити скасування справи”, – каже експерт.
Проте додає, що шанси на відхилення позову дуже мінімальні.
„Рідко бувають випадки, коли обвинувальний акт відхиляється. Обвинувачення має дуже широкі повноваження щодо того, як ведеться засідання. А сторона звинувачення абсолютно не погоджується з тим, як адвокати Болдуїна, які стверджували, що він не натискав на курок і що не знав, що в пістолеті випадково перебували бойові патрони, охарактеризували цей сценарій”, – наголосив експерт.

Тоді Болдуїн вистрілив в оператора Гатчінс з реквізитної зброї, думаючи, що вона не заряджена. Слідство намагається встановити те, яким чином заряджена зброя опинилася на знімальному майданчику.

„Це рішення не звільняє Болдуїна від кримінальної провини, і звинувачення можуть бути пред’явлені повторно. Наше подальше розслідування триватиме”, – сказано в заяві прокурорів Нью-Мексико Карі Моррісі і Джейсона Льюїса.

У самому позові йдеться про те, що Болдуїн порушив численні правила безпечного поводження зі зброєю та вчинив необережний постріл із смертельної зброї, що підпадає під кримінальну відповідальність у штаті Нью-Мексико, де сталася трагедія.
Ба більше, окрім Болдуїна, у позові також вказані відповідачами сім продюсерів фільму «Іржа» (Rust).
Сам Болдуїн заявив, що не очікує, що йому будуть пред’явлені кримінальні звинувачення, хоча місцева прокуратура відмовилася виключити це.
Адвокат родини Гатчінс Ренді МакГінн очікує, що позов буде розглянуто протягом півтора-двох років.
Як повідомлялося, 21 жовтня 2021 року під час зйомок художнього фільму «Іржа» (Rust) у штаті Нью-Мексико американський актор та продюсер Алек Болдуїн випадково застрелив операторку – 42-річну громадянку України Галину Гатчінс (Андросович). Крім того, поранення дістав 48-річний режисер Джоел Соуза. Болдуїн вистрілив з реквізитної зброї, що мала бути заряджена холостим набоєм.
Сам актор під присягою заявив, що був переконаний у безпечності зброї, яку йому вручили. У ході слідства з’ясували, що помічник режисера, передаючи зброю Болдуїну, вигукнув: «Зброя – холодна».
Жодних офіційних звинувачень Болдуїну висунуто не було. Слідство у справі триває.

Джейсон Боулз та Роберт Горенс, адвокати Ханни Гутьєррес-Рід, зброярки фільму «Іржа», розповіли свою версію, як бойовий патрон потрапив у пістолет.
«Я вважаю, що той, хто зробив це, хотів саботувати роботу на знімальному майданчику, довести свою точку зору, заявити про своє невдоволення. І ми знаємо, що напередодні люди пішли зі знімального майданчика», – зазначив Джейсон Боулз.
«Ми не говоримо, що хтось мав на меті влаштувати трагедію – убивство, але вони хотіли зробити щось, аби спричинити інцидент з безпекою під час зйомки сцени. На нашу думку, сталося саме це», – наголосив він.
Трагедія сталася 21 жовтня під час репетиції сцени із вестерну на фермі Бонанза-Крік у Нью-Мексико. Болдуїн грає головну роль у фільмі, продюсером якого є сам. На знімальному майданчику він ненавмисно бойовим патроном убив операторку та поранив режисера Джоеля Соузу. Помічник режисера Дейв Холлс сказав Болдуїну, що зброя заряджена холостими.

22 жовтня Болдуїн випадково вбив оператора Галину Хатчінс і поранив режисера Джоела Соуза на зйомках вестерну „Іржа” (Rust) у Нью-Мексико. Він стріляв із реквізитного пістолета, який виявився зарядженим бойовими патронами. Актор дав свідчення у поліції. Зйомки стрічки перервали.

Болдуін засумнівався, що зйомки «Іржі» колись відновляться.
«Вона [Галина Хатчінс] була моїм другом. У день, коли я приїхав до Санта Фе, щоб почати зйомки, я запросив її на вечерю – разом із Джоелом, нашим режисером. Причиною трагедії став постріл із бутафорської зброї.
Розпочато розслідування, повідомляє The Guardian.
„Міс Гатчінс була гелікоптером доправлена до лікарні Університету Нью-Мексико, де лікарі констатували її смерть”, – повідомив шериф.
Поранений, режисер Джоель Сауза, перебуває в лікарні.
