Річард Дж. Кастігар-молодший подав до суду після того, як у жовтні 2021-го двері автомобіля Mercedes-Benz GLE 450 2020 р. в., оснащені автоматичною системою плавного закриття, ампутували частину його великого пальця. Це сталося через рік після того, як він придбав легковик у лізинг.
Кастігар, перший заступник офісу шерифа округу Піма в Арізоні, повідомив, що коли стояв спиною до автомобіля, великий палець його правої руки ще був у дверному отворі. У цей момент автоматичний механізм раптово зачинив двері. За словами чоловіка, він відчув різкий біль і був змушений спостерігати, як машина розчавлює та відрізає його палець.
Згідно з позовом, через травму Кастігар втратить пів мільйона доларів заробітної плати, оскільки більше не зможе працювати.
«Колись гордий і незалежний чоловік, який захищає населення, тепер змушений покладатися на дружину. Вона допомагає йому йти у ванну, приймати душ, чистити зуби, одягатися, застібати сорочку», – ідеться в позові.
Позов також вимагає, щоб для уникнення подібних проблем у майбутньому двері Mercedes-Benz із автоматичним закриттям оснащали датчиками. Зазначається, що компанії не слід використовувати цю функцію без вбудованих систем, які б попереджали про потенційну небезпеку.
«Мерседес» – не єдина компанія, котра використовує таку автоматичну систему у своїх автомобілях: ці доповнення має більшість люксових брендів. Подібний позов був поданий проти BMW у 2017 році, але суддя відхилив його, мовляв, такої травми можна зазнати й через звичайні двері.
З точки зору PR, це недобре для компанії «Мерседес», адже покупці розраховують на безпечність функцій автомобілів класу люкс. Крім того, виробник сильно постраждав від епідемії коронавірусу, його продажі впали, на зниження виробництва вплинув і дефіцит чипів.
