Федеральний верховний суд Німеччини вперше схвалив екстрадицію громадянина України, який намагався уникнути її через небажання служити в Збройних силах України у зв’язку з особистими переконаннями.
Про це повідомляє MDR в середу, 12 лютого.
Судді обґрунтували свою позицію тим, що відмова від військової служби з міркувань совісті не є перешкодою для екстрадиції у випадку нападу на державу в порушення міжнародного права. Тому відповідна особа повинна очікувати, що її призвуть на службу.
Українські правоохоронці звернулися із запитом про екстрадицію чоловіка, який виїхав до Німеччини. В Україні йому інкримінують погрози й фізичне насильство над співробітником поліції під час взяття аналізу крові в лікарні.
Після початку процедури екстрадиції чоловік виступив проти повернення в Україну. Він стверджував, що його можуть призвати до лав ЗСУ. Чоловік заявив, що не хоче вбивати людей й відмовився від мобілізації з міркувань совісті.

За результатами розгляду запиту Офісу генпрокурора компетентні органи Республіки Польща прийняли рішення про видачу (екстрадицію) громадянки України – жительки Славути, яка розшукувалась правоохоронцями Хмельницької для притягнення до кримінальної відповідальності за торгівлю наркотиками.
6 лютого жінку передали українським правоохоронцям на міжнародному пункті пропуску «Устилуг-Зосін». За даними слідства, вона продавала канабіс та метамфетамін у Славуті.
У 2022 році підозрювану затримали правоохоронці. Їй повідомили про підозру у незаконному виробництві, виготовленні, придбанні, зберіганні, перевезенні, пересилці або збуті наркотичних засобів, психотропних речовин або їх аналогів (ч. 1, ч. 2 ст. 307 Кримінального кодексу України).
Крім того, жінці обрали запобіжний захід у вигляді тримання під вартою з правом внесення застави.
Після внесення застави підозрювана ухилилася від органу досудового розслідування та виїхала до Польщі, що стало підставою для її міжнародного розшуку.

Зусиллями Ужгородської окружної прокуратури вдалося забезпечити екстрадицію на територію України закарпатця, якого розшукували за підозрою у незаконному проникненні до житла, вчиненні у складі групи осіб хуліганського нападу та нанесенні тяжких тілесних ушкоджень, що призвели до смерті чоловіка (ч. 1 ст. 162, ч. 4 ст. 296, ч. 2 ст. 121 КК України).
У співпраці з Офісом Генерального прокурора до компетентних органів Федеративної Республіки Німеччина було направлено запит на видачу 33-річного громадянина для притягнення його до кримінальної відповідальності в Україні.
За результатами розгляду запиту було прийняте рішення щодо екстрадиції. Чоловіка вже передали українським правоохоронцям на міжнародному пункті пропуску «Краківець-Корчова».
Інцидент, у причетності до якого підозрюють особу, стався у серпні 2023 року в с. Порошково, що на Ужгородщині. Тоді група місцевих жителів незаконно увірвалася до будинку свого односельця та, лаючись, почала трощити майно дерев’яними палицями. Також нанесли десятки ударів по тілу та голові чоловіку, що там проживав. Він помер у реанімаційному відділенні лікарні внаслідок отриманих травм.
Після скоєного закарпатець утік і тривалий час переховувався від правосуддя за кордоном. Однак зараз у суді йому вже обрали запобіжний захід у вигляді тримання під вартою.
Також правоохоронці встановили, що на території іншої країни перебуває і спільник чоловіка. Прокуратура готує клопотання щодо його екстрадиції.
Досудове розслідування здійснює поліція Ужгородщини за процесуального керівництва Перечинського відділу Ужгородської окружної прокуратури.
Примітка: відповідно до ст. 62 Конституції України особа вважається невинуватою у вчиненні злочину і не може бути піддана кримінальному покаранню, доки її вину не буде доведено в законному порядку і встановлено обвинувальним вироком суду.

Французький суд вирішив, що через війну Костянтину Жеваго в Україні може загрожувати «несправедливий судовий розгляд».
Верховний суд Франції остаточно відмовив в екстрадиції до України бізнесмена Костянтина Жеваго, якого підозрюють у розтраті грошей банку «Фінанси та Кредит». Першим про це 10 листопада повідомило агентство Reuters.
Суд закрив справу та зняв усі обмеження на пересування власника Ferrexpo – швейцарської компанії, що займається гірничодобувною промисловістю в Полтавській області. Своє рішення судді обґрунтували воєнним станом в Україні й тим, що є «реальний ризик кричущої відмови у правосудді» за нинішніх обставин. Рішення суду є остаточним.
Згодом Офіс генпрокурора зазначив, що українські правоохоронці продовжують взаємодіяти із компетентними органами Франції щодо українського мільярдера Костянтина Жеваго, стосовно якого в Україні є ще одна підозра. В ОГП підтвердили, що за інформацією французької сторони, суд касаційної інстанції залишив в силі рішення апеляційного суду міста Шамбері про відмову у задоволенні запиту про видачу Україні колишнього народного депутата, який перебуває на території Французької Республіки.
Прокурори нагадують, що рішення апеляційного суду Шамбері було обґрунтовано тим, що Україна, перебуваючи у стані війни, «була змушена відступити від виконання обов’язків за міжнародними договорами, у тому числі в частині права на справедливий судовий розгляд та права на захист», і не може, на думку суду, гарантувати, що особа постане перед судом, який забезпечує основні процесуальні гарантії та право на захист, яких дотримується Французька Республіка.
Водночас в ОГП нагадують, що щодо Жеваго детективи НАБУ за процесуального керівництва САП здійснюють ще одне розслідування – за підозрою у наданні неправомірної вигоди голові та суддям Верховного суду України (ч. 4 ст. 369 ККУ). Зокрема 28 липня 2023 року французька сторона вручила фігуранту повідомлення про підозру у цьому провадженні.
З Костянтином Жеваго пов’язують гірничодобувну групу Ferrexpo. За даними Forbes, у 2022 році бізнесмен увійшов у п’ятірку найзаможніших українців. Тогоріч його статки сягнули 1,4 млрд грн. Ще із 2019 року Жеваго не повертався в Україну, пішов із посади гендиректора Ferrexpo і керує нею дистанційно, зазначає «Forbes Україна». Крім того, із 1998-го до 2019 року Жеваго обирався до Верховної Ради. В Україні Жеваго підозрюю у розтраті грошей банку «Фінанси та Кредит», чим було завдано шкоди інтересам держави та вкладників банку.
Нині накладено арешт на майно Жеваго, а також пов’язаних із ним компаній. Це, зокрема, акції його підприємств на сотні мільйонів гривень, корпоративні права товариств, 26 об’єктів нерухомості. Також арештовано майно інших підприємств, які пов’язані з бізнесменом. Серед іншого це: 14 майнових комплексів, 21 частина майнових комплексів, 30 нежитлових приміщень, 10 квартир, гелікоптер, яхта.

Словацька Республіка видала Україні одного з підозрюваних у справі про заволодіння 5 млн грн коштів Укрзалізниці. Гроші мали витратити на ПЛР-тести.
Про це інформують НАБУ та САП.
„11 серпня 2023 року в Україну екстрадовано одного із підозрюваних у причетності до корупційної схеми із закупівлі ПЛР-тестів на COVID-19 для АТ „Укрзалізниця””, – йдеться в заяві.
Зловмисника розшукували міжнародні правоохоронні органи з 2022 року. Улітку 2023 року його затримали в Словацькій Республіці. Країна погодилася на екстрадицію.
За даними слідства, у 2020 році посадовці Укрзалізниці організували схему розкрадання коштів під час закупівлі ПЛР-тестів на COVID-19. Для цього вони штучно підняли очікувану ціну закупівлі за одиницю на понад 400 гривень в порівнянні з ринковою та домовилися про перемогу в процедурі закупівлі з попередньо обраним співучасниками підприємством.
Загалом фігуранти мали намір заволодіти майже 5 млн грн, але через те, що договір не пройшов внутрішню процедуру схвалення, його не було підписано.
У червні 2022 року шести особам було оголошено про підозру. У жовтні того ж року – ще двом особам.
Застереження. Відповідно до частини першої статті 62 Конституції України особа вважається невинуватою у вчиненні злочину і не може бути піддана кримінальному покаранню, доки її вину не буде доведено в законному порядку і встановлено обвинувальним вироком суду.

Росіянин Вадим Конощенко, який за підозрами є діючим офіцером ФСБ, постане перед судом в американському Брукліні сьогодні за звинуваченнями у створенні мережі закупівель та відмивання коштів для російського уряду. Про це повідомило Міністерство юстиції США.
Влада Естонії заарештувала Конощенка в грудні за запитом Сполучених Штатів, і передала його до США 13 червня.
„За звинуваченнями, він був ключовим учасником схеми, призначеної, щоб надавати виготовлену в США електроніку та боєприпаси на підтримку російської війни та розробки зброї, в порушення експортних обмежень, економічних санкцій та кримінального законодавства”, – заявив прокурор США Бреон Піс.
Американські прокурори вимагають, щоб підозрюваний залишався під вартою до суду, вказуючи на високий ризик втечі.
В Мін’юсті США подякували Естонії за співпрацю в руйнуванні воєнної машини Кремля.
„Вадим Конощенок, за звинуваченнями, надавав сучасні американські технологічні товари та боєприпаси росії для використання в незаконному та неспровокованому вторгненні до України, – заявив директор програми Міністерства юстиції США KleptoCapture Адамс. – Далеко від поля бою на Конощенка тепер чекає правосуддя в американському суді завдяки рішучій підтримці естонських партнерів та федеральних прокурорів і агентів, які присвятили час та талант руйнуванню воєнної машини Кремля”.
В грудні прокуратура США висунула звинувачення п’ятьом росіянам і двом громадянам США у незаконному отриманні чутливих технологій США та боєприпасів для передачі російській армії.
Сім обвинувачених пов’язані з двома московськими компаніями з оптової торгівлі машинами та обладнанням, які діяли під керівництвом Федеральної служби безпеки росії або ФСБ, правонаступника радянського КДБ, згідно з обвинувальним висновком від 5 грудня, оприлюдненим у вівторок.
Дві компанії «Сернія Інжиніринг» і ТОВ «Сертал», разом із кількома іншими, які вважаються «важливими для воєнної машини Російської Федерації», перебувають під санкціями міністерств фінансів і торгівлі США після вторгнення росії в Україну 24 лютого.
У обвинувальному акті йдеться, що “Сернія” очолювала «мережу незаконних закупівель», ухилялась від санкцій США та Заходу, щоб «придбати важливу військову техніку та технології подвійного призначення, включаючи напівпровідники, для російської армії, ВПК та науково-дослідних установ».
Згідно з обвинуваченням, так звана „мережа Сернія” діяла щонайменше з 2017 року, і один обвинувачений нібито намагався незаконно переправити до Росії ще минулого місяця тисячі куль, які використовуються в снайперських гвинтівках.
Щоб приховати участь російського уряду та справжню особу кінцевих користувачів, “Сернія” і “Сертал” керували великою мережею підставних компаній і банківських рахунків по всьому світу, а поставки здійснювалось в основному через Естонію, Фінляндію, Німеччину та Гонконг, згідно з обвинуваченням.
Конощенок, який проживав в Естонії, нібито відправляв, або контрабандою вивозив електроніку подвійного призначення американського походження, тактичну амуніцію військового класу та інші експортно-контрольовані товари з балтійської країни до росії.
У жовтні Конощенка зупинили на естонському кордоні з 35 різними видами чипів та інших електронних компонентів, а також тисячами американських куль калібру 6,5 мм (приблизно 0,26 дюйма), які використовуються у військових снайперських гвинтівках, згідно з обвинуваченням.
Наприкінці листопада його знову зупинили на російсько-естонському кордоні з приблизно 20 гільзами, що містили тисячі американських куль, у тому числі тактичних і військових снайперських патронів калібру.338, йдеться в документах обвинувачення.

Міністр внутрішніх справ Великобританії Пріті Патель схвалила екстрадицію засновника WikiLeaks Джуліана Ассанжа до США для притягнення його до кримінальної відповідальності.
«17 червня, після розгляду як магістратським судом, так і Високим судом, було ухвалено рішення про екстрадицію пана Джуліана Ассанжа до США. Пан Ассанж зберігає звичайне 14-денне право на оскарження», – йдеться у заяві Міністерства внутрішніх справ, пише Радіо Свобода.
Натомість у заяві Wikileaks в твітері йдеться: «Міністр внутрішніх справ Великобританії схвалила екстрадицію видавця WikiLeaks Джуліана Ассанжа до США, де йому загрожує 175-річний термін – чорний день для свободи преси та британської демократії. Рішення буде оскаржено».
Суд у Лондоні ще 20 квітня дозволив екстрадицію засновника Wikileaks Джуліана Ассанжа до США. Остаточне рішення про екстрадицію залишалося за міністром внутрішніх справ Пріті Пател.
У США Ассанжу висунули 17 звинувачень у шпигунстві і одне звинувачення щодо публікації WikiLeaks тисяч військових і дипломатичних документів. Журналістські організації та правозахисні групи закликали Велику Британію відхилити запит про екстрадицію. Прихильники та адвокати Ассанжа стверджують, що він діяв як журналіст і має право на захист свободи слова.
Ассанж зараз утримується в лондонській в’язниці суворого режиму Белмарш.

Одне з важливих завдань, яке покладено на військовослужбовців Національної гвардії України, є екстрадиція осіб. Це одна з форм міжнародної співпраці в боротьбі зі злочинністю. Аби якісно виконувати це завдання, окрім фахової підготовки, необхідна і якісно налагоджена взаємодія з Державною Прикордонною службою та Інтерполом.
Здавалося б, що може бути складного у тому, аби приїхати на один з пунктів пропуску на державному кордоні, прийняти злочинця (чи привезти його) та отримати його з рук правоохоронців іншої країни (чи передати іноземним полісменам). Але ж ні, процес підготовки до екстрадиції доволі кропіткий і тут потрібні не лише тренування, а й, в деяких випадках, багаторічний досвід роботи.
Карантинні заходи у світі, у зв’язку з захворюваністю на COVID-19, внесли свої корективи у виконання завдань з екстрадиції. Ні, виконувати їх не перестали і це ніяким чином не відобразилось на якості їх виконання. Просто відтепер потрібно дотримуватись суворих мір безпеки щодо здоров’я нацгвардійців та осіб, які задіяні до екстрадиції.
Підготовка до екстрадиції відбувається так само як і раніше. Розпочинається вона з відбору військовослужбовців. Звертається увага на їх досвід, кваліфікацію, фізичні дані. Вони проходять медичний огляд, з ними працює психолог. Перед виїздом обов’язково проводяться інструктивні заняття, на яких відпрацьовують прийми рукопашного бою, порядок виконання служби, надання першої медичної допомоги та дії особового складу варти у разі виникнення надзвичайної ситуації.
Тільки відтепер нацгвардійці 2 Галицької бригади виконують усі ці дії у захисних костюмах, масках, рукавичках. По прибуттю на пункт пропуску усім обов’язково заміряють температуру. Стосується це і тієї особи, яку нацгвардійці беруть під варту. Але температурний скринінг роблять представники Державної прикордонної служби. Обов’язковим є і часта дезінфекція рук.
«Нещодавно ми виконували завдання по екстрадиції на пункті пропуску Краковець-Корчова, – розповідає підполковник Валерій Демчук. – Наші іноземні колеги, як і ми, дотримуються карантинних заходів. Усі вони теж були в рукавичках і масках. Усі необхідні документи заповнюються тільки в рукавичках. Та особа, яку ми брали під варту, теж була в захисній масці. Представники Мостиського Прикордонного загону заміряли температуру, оформили усі необхідні документи. В принципі, карантинні заходи ніяким чином не впливають на виконання екстрадиції».
