490 millió dollár kártérítést fizet a Michigani Egyetem több mint ezer férfinak, akik állítják, hogy a 2008-ban elhunyt Robert Anderson sportorvos szexuálisan bántalmazta őket – számolt be szerdán a BBC.
Az Anderson elleni vádak nagy része szükségtelen végbél, illetve herevizsgálatokat rótt fel a sportorvosnak. A BBC hozzátette, hogy a 490 millió dolláros összegből 30 millió dollárt a jövőbeli vádlóknak tettek félre. A vádak közül volt, ami még az 1960-as évekből került elő.
Az egyezséget 15 hónapig tartó tárgyalássorozat után jelentették be a felek. Egy ügyvéd ezt követően úgy fogalmazott, hogy a megegyezés „igazságot és gyógyulást” hozhat az áldozatoknak. 2018-ban rendőrségi nyomozás indult az ügyben, az azt állapította meg, hogy Anderson ellen – mivel elhunyt – nem lehet vádat emelni.
2020-ban a Michigani Egyetem elnöke elnézést kért minden áldozattól. Egy évvel később az intézmény egy független jelentést rendelt meg, ami megállapította, hogy Robert Anderson 1966-tól 2003-ig tartó pályája során az egyetem rengeteg lehetőséget szalasztott el a szexuális ragadozó megfékezésére.

Egy kanadai bíróság csaknem 75 millió euró kifizetését rendelte azon hat család számára, akik rokonai az „Ukrajna Nemzetközi Légi járatai” gépének Teherán feletti balesetében vesztették életüket. Egyelőre nem tisztázott, hogy az áldozatok családjai miként kapják meg az összeget Irántól.
A kanadai Ontario tartomány Legfelsőbb bírósága január 3-án hozott ítéletet, miszerint Iránnak 107 millió kanadai dollárt (közel 75 millió eurót) kell kifizetnie az „Ukrajna Nemzetközi Légi járatai” (Ukraine International Airlines) két évvel ezelőtti teheráni katasztrófája hat áldozata hozzátartozóinak.
Egyelőre nem tisztázott, hogy az elhunyt kanadaiak hozzátartozói hogyan kapják meg a pénzt Teherántól. A bírósági ítélet azonban szimbolikus jelentőségű azoknak a családok számára, akik az iráni nyomozás átláthatóságának hiányára és az igazságszolgáltatás képtelenségére panaszkodtak, közölte az AP.
Megjegyzendő, hogy a kártérítésről Edward Beloboba kanadai bíró döntött, aki májusban arra a következtetésre jutott, hogy Irán, amikor lelőtt egy utasszállító repülőgépet – terrorcselekményt követett el. Ez lehetővé tette az áldozatok családjainak, hogy kártérítésért pereljenek. 1,5 milliárd kanadai dollár kártérítést követeltek. Teherán akkor elítélte a határozatot, mondván, hogy az „alaptalan”, és Kanadának nincs joghatósága a kérdésben.
2021 júniusában Svédország, az Egyesült Királyság, Ukrajna és Kanada pert indított Irán ellen, az áldozatok családjai számára kártérítést követelve. Ezzel egy időben a kanadai hatóságok közzétették a kanadai igazságügyi szakértők egy csoportjának jelentését az Ukraine International Airlines utasszállító repülőgépének iráni katasztrófáját illetően, amely megerősíti, teljes mértékben az iráni polgári és katonai hatóságok felelősek a gép lezuhanásáért.
„Ukrajna Nemzetközi Légi járatai” gépének katasztrófája
Az „Ukrajna Nemzetközi Légi járatai” Boeing 737-800 típusú utasszállító PS752-es, Teherán-Kijev járatot teljesítő repülőgépe 2020. január 8-án, közvetlenül a felszállás után lezuhant a Teherán melletti Imám Khomeini nemzetközi repülőtér környékén. A fedélzeten 167 utas, többek között 57 kanadai állampolgár és kilenc fős személyzet tartózkodott. Az utasok többsége az iráni újévi ünnepeket követően utazott Torontóba, hogy folytassa tanulmányait és munkába álljon. Mindnyájan életüket vesztették. Irán 2020. január 11-én közölte, hogy a katonák „tévedésből” lőttek le a Boeing-et. Ukrajna és Irán között 2020 júliusa óta folynak a tárgyalások a tragédia kivizsgálását valamint a kártérítés kérdését illetően. 2020. december 30-án az IRNA iráni állami hírügynökség bejelentette, hogy az iráni kormány 150 000 dollár kártérítést fizet ki a repülőgép-szerencsétlenség 176 áldozata családtagjainak. Ezt a kijelentést élesen bírálták ukrán és kanadai tisztviselők, mondván, hogy a kártérítés mértékéről nem lehet egyoldalúan dönteni.

Mansonnak más ügyei is vannak a két évvel korábbi köpködésen kívül: korábban az amerikai celebvilág több ismert szereplője is zaklatással, bántalmazással vádolta meg, köztük volt partnere, Evan Rachel Wood színésznő. Ő azt állította róla, hogy már tinédzserkorában „elkezdte becserkészni” őt, majd kapcsolatuk során lelkileg, testileg és szexuálisan is bántalmazta.

Csoportos kártérítési keresetet nyújtott be 500 Covid-19 elhunyt családja az olasz kormány, az egészségügyi minisztérium és Lombardia tartománya ellen.
Jelképes százmillió euró, vagyis több mint három és fél milliárd forint kártérítést követelnek az olasz kormánytól és az egészségügyi hatóságoktól a Lombardia tartományban az új koronavírus-járvány terjedése kezdetén meghalt betegek családtagjai a római bíróságon csütörtökön kezdődött perben.
A halottaiknak igazságot követelő rokonok a bíróság épülete előtt úgy nyilatkoztak, az igazságszolgáltatástól várnak választ a politikától megválaszolatlan kérdésekre.
“Tudni akarjuk, meg lehetett volna menteni a szeretteinket” – mondta egy férfi a sajtónak.
A 2020 februárjában Covid-19-ben elhunyt ötszáz beteg családjai indítottak csoportos kártérítési keresetet a kormány, az egészségügyi minisztérium és Lombardia tartomány ellen.
A per az észak-olaszországi tartomány egyik gócpontjában, Alzano Lombardo és Nembro város közötti térségében meghalt idősek halálának körülményeit kívánja tisztázni: kórházban vagy idősotthonban elhunyt betegekről volt szó a pandémia első heteiben, amikor még nem volt közismert a járvány terjedése.
Az elsőnek tartott Covid-19 beteget tavaly február 20-án azonosították a lombardiai Codognóban, ami az új koronavírus-járvány hivatalos kezdeti dátumának számított. A kártérítést követelők szerint azonban a betegség már korábban jelen volt a térségben. Az ügyvédeik által benyújtott több mint kétezer oldalas vádirat szerint a kisvárosok kórházai már januárban tele voltak tüdőgyulladásos idős beteggel.
Mindennek ellenére Alzano Lombardo és Nembro idősotthonai és kórházait csak február 23-án zárták le, majd a pánik elkerülésére hivatkozva egy nap után újranyitották. A teljes zárlatot csak március közepén rendelték el.
A halottanként 200 ezer euró kártérítést követelő családtagok úgy látják, hogy az akkori, Giuseppe Conte vezette kormány és a Roberto Speranza vezette egészségügyi tárca alulbecsülte a veszélyt, és nem cselekedett a lakosság védelmében.
A volt miniszterelnököt, a volt és jelenlegi egészségügyi minisztert, valamint Lombardia tartományi vezetőit Bergamo ügyészsége is meghallgatta már a vizsgálat keretében, amely szintén arra keres választ, hogy a hatóságok időben léptették-e életbe a járvány miatti válságintézkedéseket.
Lombardia régióban, és kiemelten Bergamo térségében volt a legmagasabb a halottak lakossághoz mért aránya a járvány első hullámában.

A pár éve kirobbant dízelbotrány ügye napjainkban zárult le, a világ egyik legnagyobb autógyártójának egykori vezetőjét arra kötelezték, hogy hatalmas mennyiségű pénzt folyósítson a Volkswagennek.
A VW kártérítési követeléséről kötött peren kívüli megállapodás szerint 288 millió euró jár a cégnek.
Martin Winterkorn 11,2 millió eurót fizet, Rupert Stadler, az Audi volt vezérigazgatója 4,1 millió eurót, Wolfgang Hatz, a Porsche volt vezérigazgatója 1,5 milliót, Stefan Knirsch, az Audi volt fejlesztési vezetője pedig egymillió eurót.
A fennmaradó mintegy 270 millió eurót az egykori beosztásukhoz kapcsolódó biztosítási konstrukciók – vezető tisztségviselők felelősségbiztosítása (D&O) – révén fedezik.
Ez a D&O típusú biztosítások németországi történetének legnagyobb szabású megállapodása. A megállapodás nem érinti a dízelbotrány miatt Winterkorn és más volt VW-vezetők ellen indított büntetőeljárásokat.
A volt vezérigazgató ellen például még 2019-ben emeltek vádat, az ügyészség szerint a törvényi kötelezettségek megszegésével szándékosan túl későn tájékoztatta a részvényeseket a dízelbotrányból fakadó milliárd eurós nagyságrendű költségekről, amivel törvénytelenül befolyásolta a társaság részvényének árfolyamát.
Rupert Stadlert a többi között csalással vádolják. A 2020-ban indított per vádirata szerint legkésőbb a VW dízelbotrányának kirobbanása révén, 2015 szeptemberében tudomást szerzett a dízelmotoroknál alkalmazott manipulációról, mégis utasítást adott az érintett gyártmányok forgalmazására, illetve nem akadályozta meg értékesítésüket.
A VW dízelbotránya 2015 szeptemberében kezdődött, amikor az Egyesült Államok Környezetvédelmi Ügynöksége (EPA) megvádolta a vállalatcsoportot, hogy olyan szoftvert telepített 482 ezer dízelüzemű jármű kipufogógáz-tisztító berendezésébe, amely érzékeli a mérés körülményeit. Az autó így a teszteken a valóságos nitrogén-oxid-kibocsátás töredékét produkálja, vagyis csal a vizsgán.
A VW az autóipar legnagyobb szereplője, a csoporthoz tartozik a névadó Volkswagen mellett az Audi, a Bentley, a Bugatti, a Lamborghini, a Porsche, a Seat és a Skoda, valamint a Ducati sportmotorkerékpár, és saját márkájú haszonjárművei mellett a Scania és a MAN tehergépjárműveket is a VW gyártja.

A VW közlése szerint hosszas vizsgálat után megállapítást nyert, hogy a két volt vállalatvezetőt felelősség terheli azért, hogy egyikük sem tevékenykedett elvárható óvatossággal és figyelemmel. Winterkorn nem sokkal az után mondott le tisztségéről, hogy 2015 szeptemberében kirobbant az úgynevezett dízelgate-botrány: kiderült, hogy egyes VW-modellekbe a gyár olyan szoftvert telepített, amelyek észlelték, ha tesztelték a motort és ekkor a motor automatikusan csökkentette a teljesítményt és ezzel mérséklődött a gyár által közöltnél magasabb károsanyag-kibocsátás. A botrány következményei – a kártérítések és az egyéb költségek – eddig 30 milliárd eurót emésztettek fel.
Winterkorn és négy további VW-vezető ellen hivatalosan is eljárás indult csalás és adóelkerülés vádjával. A pernek már meg kellett volna kezdődnie, ám az illetékes bíróság a koronavírus-járványra való tekintettel szeptemberre halasztotta az eljárást folytatását.

Pénteken Minneapolis városa megállapodásra jutott a rendőrök által meggyilkolt George Floyd családjával a család által elindított polgári perben – írja az AP amerikai hírügynökség.
A megállapodás szerint minneapolisi vezetés 27 millió dollár (átszámítva több mint nyolcmilliárd forint) kártérítést fog fizetni a 47 éves férfi haláláért.
A Floyd-család jogi képviselője, Ben Crump sajtótájékoztatóján elmondta, hogy eddig ez a legnagyobb összeg, amelyet tárgyalás előtti megállapodás nyomán kifizetnek egy polgári perben. Erős üzenetet közvetít arról, hogy a feketék élete igenis számít és, hogy a nem fehér bőrűek elleni rendőri brutalitásnak véget kell vetni – emelte ki az ügyvéd.
A George Flyod meggyilkolásáról virálissá vált videó váltotta ki a Black Lives Matter mozgalom több hónapon át tartó, a rendőri brutalitás elleni tüntetéssorozatát. A mozgalmat Nobel-békedíjra is jelölték 2021 januárjában.

Nyugvópontra ért az online világ eddigi egyik legnagyobb, adatkezelést érintő pere. A Facebook összesen 650 millió dollár kártérítést fizet azon, az amerikai Illinois államban élő felhasználóinak, akik azzal vádolták, hogy engedély nélkül használta fel képmásaikat.
Az ügy még 2015-ben indult, amikor a cég a felhasználók fotókon történő megjelöléséhez arcfelismerő mesterséges intelligenciát is bevetett. Ez a userek egyéb, korábban feltöltött fényképei alapján javasolta megjelölésüket a fotókon, ami kifejezett engedélyezés nélkül törvénybe ütközik Illinoisban. Minden sértett legalább 345 dollárt kap. Eredetileg összesen 100 millióval kevesebbet akart fizetni a társaság, de azt a perben ítélkező bíró kevesellte – közölte a Cnet.
A Facebooktól azt nyilatkozták, hogy elégedettek az eredménnyel, és örülnek, hogy maguk mögött hagyhatják ezt az ügyet, ami a részvényeseknek és a felhasználóknak egyaránt érdeke.

A nő korábban már kétezer eurónyi kártérítést kapott az államtól, most viszont újabb összegeket követel, összesen 125 ezer eurót. Az áldozat édesanyja részben a tragédia nyomán elszenvedett fájdalom jogcímén, részben pedig a saját kezeltetésének szükségességére, valamint a temetés költségeire hivatkozva követeli ezt az összeget.
A család egyelőre még nem indított pert az állam ellen, hanem egy peren kívüli megegyezést szerettek volna elérni a hatóságokkal. Állításuk szerint azonban az állam nem válaszolt a megkeresésükre, ezért bíróság elé fogják vinni az ügyet.
A bécsi terrortámadás körülményeire vonatkozó nyomozás végső jelentését szerdán publikálták az osztrák hatóságok. A dokumentum megerősítette azt a feltételezést, miszerint az állam által elkövetett mulasztások is hozzájárultak ahhoz, hogy nem sikerült megakadályozni a terrortámadást.
A jelentés szerint az osztrák hatóságoknak a „potenciális veszélyfaktorok” felismerésében fejlődniük kell, valamint az egymással való kommunikációt kell fejleszteniük. Az ehhez szükséges szervezeti átalakításokat Karl Nehammer belügyminiszter, valamint Werner Kogler alkancellár vezetésével már meg is kezdték.
