A Los Angeles Times című lapban közzétett véleménycikkében a kormányzó – aki politikai példaképének nevezte a meggyilkolt politikust – leszögezte: a 77 éves Sirhan még mindig nem érzi át tette súlyát, továbbra is igyekszik elhárítani magáról a felelősséget, és emiatt veszélyt jelentene, ha visszaengednék a közösségbe.
A demokrata párti kormányzó hangsúlyozta: a merénylő az Egyesült Államok történetének egyik legszörnyűbb bűncselekményét követte el.
Newsom döntése megosztotta a Kennedy-családot is: a meggyilkolt politikus özvegye, a 94-ik évében járó Ethel Kennedy mély megkönnyebbülését fejezte ki, a pár kilenc gyermeke közül viszont ketten – ifjabb Robert F. Kennedy és Douglas Kennedy – támogatták Sirhan B. Sirhan kérelmét. Ifjabb Robert Kennedy tavaly decemberben, a San Francisco Chronicle című lapban közölt véleménycikkében azt állította, nem Sirhan ölte meg az apját.
Az elítélt férfi ügyvédje, Angela Berry közleményében azt vetette Newsom szemére, hogy döntésének politikai okai voltak. „Biztosak vagyunk benne, a bírósági felülvizsgálat bebizonyítja, hogy a kormányzó tévedett” – tette hozzá.
Newsom azt követően döntött így, hogy Kalifornia feltételes szabadlábra helyezésekről döntő bizottsága augusztusban beleegyezett, hogy a palesztin származású Sirhan B. Sirhan elhagyhassa a börtönt. A törvény értelmében a döntés 90 napos felülvizsgálati időszak után került a kormányzó elé.
Sirhant 1969-ben ítélték halálra a demokraták elnökjelöltségéért induló Robert Kennedy meggyilkolásáért. Az ítéletet később – miután Kaliforniában eltörölték a halálbüntetést – életfogytiglani börtönbüntetésre változtatták.
A szabadlábra helyezésről döntő bizottság korábban 15 alkalommal utasította el Sirhan szabadlábra helyezés iránti kérelmét.
Robert Kennedy a demokraták egyik elnökjelölt-aspiránsa volt, amikor a 24 éves Sirhan 1968. június 6-án a Los Angeles-i Ambassador Hotelben lelőtte őt, néhány perccel azután, hogy győzelmi beszédet mondott a kulcsfontosságú kaliforniai előválasztáson. A palesztin születésű Sirhan családja 1956-ban települt át az Egyesült Államokba. Egykori vallomása szerint Sirhan Kennedynek az 1967-es, hatnapos arab-izraeli háború során tett kijelentései miatt határozta el magát a merényletre. Később viszont többször is azt vallotta, hogy nem emlékszik a gyilkosságra, csak az azt megelőző történéseket tudja felidézni.
