Az amerikai igazságügyi minisztérium szerint a 28 éves Csuan Gen és Si-vej Jang 2022 októbere és 2025 júliusa között exportáltak fejlett mikroprocesszorokat a szükséges engedélyek nélkül.
Az H100 az NVIDIA egyik legkorszerűbb mesterséges intelligencia chipje, amely 2022 óta exportkorlátozás alá esik az Egyesült Államokban.
A nyomozás feltárta, hogy a vádlottak által létrehozott ALX Solutions nevű vállalatot röviddel az amerikai korlátozások bevezetése után alapították. A házkutatások során olyan levelezéseket találtak, amelyek a törvények kijátszására irányuló próbálkozásokat dokumentálták – például a chipek Malajzián keresztüli továbbítását. 2024 decemberében a cég több mint 20 szállítmányt küldött Szingapúrba és Malajziába, ezeket az országokat gyakran használják tranzitállomásként csempészésre. A fizetések nem hivatalos ügyfelektől, hanem hongkongi és kínai cégektől érkeztek.
Az FBI és az Ipari és Biztonsági Hivatal továbbra is vizsgálódik. Gen és Jang az exportellenőrzési reformtörvény megsértésével vádolhatók, ami akár 20 év börtönbüntetést is vonhat maga után. Emellett kiderült, hogy Jang vízuma lejárta után illegálisan tartózkodott az Egyesült Államokban.
