A New York-i főügyészi hivatal közleménye szerint a büntetés-végrehajtási intézmény több mint egy tucat munkatársa lehetett jelen, amikor nekiestek Robert Brooksnak. Az intézmény tizennégy munkatársát a vizsgálatok idejére felfüggesztették. A pénteken nyilvánosságra hozott négy testkamerás felvételen az látszik, hogy megbilincselték a 43 éves férfit, majd verni kezdték. Az őrök perceken keresztül ütötték Brooksot, aki a felvételek szerint nem tudott védekezni sem.
Miután felrakták az asztalra, az egyik őr zárt ököllel mellkason ütötte a rabot, de az ágyékát is megtaposták. A testkamerás felvételek alapján két ápoló mindeközben a folyosón várakozik, és időnként bekukkantanak a szobába. A végén aztán behívják az ápolókat a szobába, hogy ellenőrizzék, életben van-e még a 43 éves férfi.
Az orvosszakértő jelentése szerint Brooks töréseket és sérüléseket szenvedett a felsőtestén, az ágyékán, a nyakán és a fején, valószínűleg „a nyak összenyomódása miatti fulladás következtében” halt meg.
Az államügyész közleményében arról írt: felelőssége és kötelessége átláthatóságot, elszámoltathatóságot biztosítani az áldozat családjának és New York állam minden polgárának. Ezzel indokolta a felvételek közzétételét is.
A New York-i Polgárjogi Unió (NYCLU) közleménye szerint Brooks bántalmazása nem elszigetelt eset, és megmutatja, hogy következmények nélkül bántalmazhatják az őrök a rabokat.
